MONTCLAIR ESSEX COUNTY NEW JERSEY DIVORCE MEDIATOR
The New Jersey domestic violence restraining order against the ex-husband is reversed. He drove by the ex-wife's home on 3 occasions and yelled "you’re going to pay." But he claimed he drove from his home in Maine to Cape May, where his ex-wife and children lived, to satisfy a warrant that was issued for non-payment of child support because plaintiff reneged on her commitment to have Probation suspend his child support obligation while the children were with him for the summer. While in Cape May, he claimed he drove by the house to check on the children. The remarks were not like the "regular serious abuse" the Legislature intended to prohibit when it enacted the domestic violence law. Covert v. Covert, New Jersey App. Div., September 3, 2008
