On two different occasions, the wife tried to have her husband murdered. She was convicted and is presently in prison. In her absence, her mother [the maternal grandmother] brought an action to compel grandparent visitation, including pendente lite visitation. The New Jersey divorce judge rejected the father's motion to dismiss the grandmother' complaint and granted her pendente lite visitation. The Appellate Division grants the father's interlocutory appeal, reverses, dismisses the complaint and denies visitation. Phillips v. Grogan, New Jersey App. Div., August 5, 2008
